RENTAL RESERVATION MUST BE PAID FOR ON THE SAME DAY OF BOOKINGS. UNPAID RESERVATIONS WILL BE CANCELLED BY CLOSE OF BUSINESS

FIRST TIME RENTERS WILL BE SUBJECT TO A 10% RETAIL DEPOSIT ON RENTAL ITEMS (ie: IF THE ITEM RENTED SELLS FOR $1000, YOU WOULD BE REQUIRED TO PUT A $100 DEPOSIT DOWN ON THAT ITEM)
Person reserving the equipment MUST pick up the their rental in person and show a valid government issued ID and the credit card used for the rental.

1.  Biggs Camera hereby rents to Person or Company name that appears on Rental Contract Agreement, which is identified in this agreement as ["RENTER"] and RENTER hereby rents and hires from Biggs Camera all of the items of EQUIPMENT and other property described above on the rental contract and made a part of this rental agreement [the "EQUIPMENT"].
2. TERM. The term of this Rental Contract Agreement commences on the "Pickup Date" shown on the rental contract and/or invoice and ends when the EQUIPMENT is returned in good condition and repair to Biggs Camera premises. It is the obligation of RENTER to arrange for the pick-up and return of all EQUIPMENT, and all such transportation is at the sole risk and expense of RENTER.
3. RENT. The rent for each and every item of EQUIPMENT is the amount set forth in this contract. Biggs Camera shall be entitled to immediate payment of all Rentals before issuance of equipment being rented. Additional charges for late returns will be charged at the conclusion of the Rental Term. Charges for lost, stolen, or damaged equipment will be assessed and charged to the credit card on this contract once the appropriate charge is determined.Prices, deposits and specifications in our catalog are subject to change without notice. Biggs Camera rental prices are based on the premise that the renters are experienced and well trained. Our gear is professional equipment and is not recommended to the inexperienced. Failure to understand the equipment operation is not an excuse for non-payment!! Payment in full is due at the time of rental.
4. SECURITY. To insure the timely return of the EQUIPMENT to Biggs Camera, RENTER shall file with Biggs Camera as security a credit card number with a balance available equal to the full replacement cost of the EQUIPMENT or as otherwise determined by Biggs Camera. Upon the return of the EQUIPMENT, payment for any repair, replacement, rental or other cost to Biggs as provided for herein, shall be charged to RENTER credit card.
5. RENTER'S INSPECTION. RENTER agrees that it has or will inspect the EQUIPMENT not later than its delivery of possession to RENTER and that it shall be conclusively presumed that RENTER has fully inspected the EQUIPMENT, is satisfied and has accepted the EQUIPMENT in good condition and repair.
6. NO WARRANTIES. BIGGS CAMERA  MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION, THE CONDITION OF THE EQUIPMENT, ITS MERCHANTABILTY OR ITS FITNESS FOR ANY PARTICULAR PURPOSE. BIGGS CAMERA SHALL NOT BE RESPONSIBLE FOR ANY LOSS OF DATA DUE TO EQUIPMENT MALFUNCTION OR OTHERWISE NOR FOR THE LOSS OF ANY DATA THAT IS STORED ON ANY RENTED MEDIA STORAGE DEVICES.
7. LOSS AND DAMAGE. RENTER hereby assumes and shall bear the entire risk of loss or damage to the EQUIPMENT from any and every cause whatsoever. No loss or damage to the EQUIPMENT or any part thereof shall release any obligation under this rental agreement, which shall continue in full force and effect. RENTER is responsible for the return of all digital equipment in the same condition as delivered upon pick up. In the event of any loss or damage of any kind whatsoever to any item of EQUIPMENT, RENTER shall (a) restore it to good condition and repair or replace it with like EQUIPMENT acceptable to Biggs Camera, in good condition and repair, or (b) if in the reasonable judgment of Biggs Camera any item of EQUIPMENT is determined by Biggs Camera to be lost, stolen, destroyed or damaged beyond repair, pay Biggs Camera the full replacement value thereof as set forth in this contract.
8. INDEMNITY. RENTER agrees to indemnify and hold Biggs Camera harmless from and against any and all claims, actions, suits, proceeding, costs, expenses, damages and liabilities, including reasonable attorney's fees arising out of, connected with, or resulting from the use of the EQUIPMENT. Each party agrees to give the other the prompt notice of any such claim or the institution of any action, suit or proceeding.
9. BIGGS CAMERA EXPENSES. RENTER shall reimburse Biggs Camera for all costs and expenses, including reasonable attorney's fees incurred by Biggs Camera in exercising any of its rights or remedies or enforcing any of the terms, conditions or provisions of this agreement.
10. ASSIGNMENT. RENTER shall not (a) assign, transfer, pledge or hypothecate this Rental Contract Agreement, the EQUIPMENT or any part thereof or any interest therein (b) sublet or lend the EQUIPMENT or any part thereof or permit the EQUIPMENT or any part thereof to be used by anyone other than RENTER or RENTER's employees. Subject always to foregoing, this Rental Contract inures to the benefit of and is binding upon the heirs, legatees, personal representatives, successors and assigns of the parties hereto.
11. OWNERSHIP. The EQUIPMENT is and shall always be and remain, the sole and exclusive property of Biggs Camera, and RENTER shall have no rights therein except as expressly set forth herein.
12. NON-WAIVER. No covenant, term or condition of this Rental Contract can be waived except by the written consent of Biggs Camera. Forbearance, indulgence or the failure to insist on the terms hereof by Biggs Camera in any regard whatsoever shall not constitute a waiver of the covenant, term or condition to be performed by RENTER to which the same apply and until complete performance by RENTER of said covenant, term or condition. Biggs Camera shall be entitled to invoke any remedy available to Biggs Camera under this Rental Contract or by law or in equity despite said forbearance, indulgence or the failure to insist on strict compliance with the terms hereof.
13. RENTER THEFT. The EQUIPMENT is and shall always be and remain, the sole and exclusive property of Biggs Camera, and RENTER shall have no rights therein except as expressly set forth herein. Law Enforcement Authorities will be notified if at the sole discretion of Biggs Camera, THEFT by the RENTER is determined to have occurred.
14. THEFT. The RENTER is determined to have committed THEFT if the EQUIPMENT has not been returned to Biggs Camera within 48 hours of the RETURN DATE as set forth in the RENTAL CONTRACT AGREEMENT and/or RENTER INVOICE. If at any time Biggs Camera has any reasonable cause to believe that the RENTER intends to commit THEFT proper Law Enforcement Authorities will be notified.
15.  “TRY BEFORE YOU BUY” POLICY If you rent equipment for the purpose of trying it out before purchasing that item, the following applies to the purchase of the same equipment: Up to 2 days of rental charges can be applied to the purchase of the same equipment that is new. The new item must be purchased within ten days of the return of the rental item. 
16. RESERVATIONS Because all equipment is rented on a first come first served basis, a reservation is recommended and may be scheduled up to one month in advance. 
17. CANCELLATIONS All reservations must be cancelled with a minimum of 24 hours advance notice. Cancellations with less than 24 hour notice are subject to a cancellation fee equal to the full amount of the rental rate. 
18. SPARE BULB Spare bulbs are provided upon request. There is no charge for the use of spare bulbs as long as the “burnt out” bulb is returned. However, any missing bulbs, shock failures, over-volting or bulbs which show signs of overheating will be charged to the renter.
19. SPARE BATTERY POLICY Alkaline, Lithium and Silver Oxide batteries are considered expendable items. Biggs Camera provides rested batteries for each rental item, but cannot guarantee the viability of the batteries. It is highly recommended that you carry spare batteries.Please allow ample time for charging of batteries, as we make every effort, but make no guarantees that batteries will be fully charged.
